Actually, Google wants to be held at fault. At least that's their stated position.

Google has no incentive to do better. There's some hubris involved, but there's also a lot of sociopathic indifference.

A class action suit might give it the motivation it needs to start behaving responsibly.

I was wondering about this, too, if some people won't just sue Google.

I think this lawsuit is a sign that Google's management miscalculated. The last thing they wanted was for this issue to drag on. They don't want to be on the front lines of the culture war. They want to build great things and make piles of money.

Even if they sued and won, google could pay any damages out of petty cash. You'd have to be extremely sure of yourself to try and sue google.

Google can certainly afford to litigate, and it's unclear to me what they'd be sued over in any case.

What Google is doing is wrong. That's literally what the lawsuit is about.

I don't agree that companies should be absolved of blame simply because they're acting in fear of a lawsuit. You are right, the DMCA is the culprit here but equally disgraceful is the sheer cowardice on Google's part. They can afford to fight for their users and techno-utopian ideals but it's far cheaper to employ half-baked technological solutions instead.

Something tells me that suing Google, regardless of the validity of the claim, is not easy.

I'm rarely on Google's side these days, but this is one fight that I'm glad they're the ones fighting it. They have the resources to put up a compelling case, and hopefully it's enough to stand in court.

So then a different google subsidiary with no clear connections will file the suit next. Also if google wants to do something or ruin someone a few million dollar fine isn't going to deter them one bit

To my knowledge, Google has started exactly 2 lawsuits in it's history.

I don't understand why the fear of being sued is not preventing Google (and other big players) from misusing their position like this. Is it impossible to sue Google?

They will sue if they see an emerging threat to the survivability of their core buisness. No one can touch Google on their ads and search ecosystem so they won’t sue. This is an illusion of benevolence.
