Sadly, this isn't over. The appeals court simply overturned a lower court decision and remanded the case back to the lower court.

They still have a chance to appeal the judgment.

If someone did and it took 10 years to resolve, that'd be an issue

(Note: A lot of states have deadlines on appeal resolution, etc, for criminal cases)


It's a bit unfair to say he was out on a technicality. The appeals judge ruled that the venue was improper, and venue can be extremely important. Not to mention the judge also saw several issues with the original charges.

They did loose, then they appealed and settled.

They had a second chance in court, and blew that one too.

It was eventually overturned on appeal, but not after a year or two in prison and great financial ruin.

In otherwords, the evidence wasn't strong enough to overturn the conviction and was available through other means.


Maybe he does lose, but how long will that take? With the appeals? They’ll probably just settle out of court.

Yes, but the overturn wasn't based on urls, or scraping, or disclosure, or security, or damages, it was based on him being charged in the wrong state. The court system still thinks everything else about the case was fine.
