We did no such thing, but do you have a reference to Bezos saying that? I know Amazon does not negotiate over contract terms, but that's something different than prizes.
If they offered this option it would be an admission on Amazon's part that they know about the issues with co-mingling (which of course they must do by now, but they wouldn't be dumb enough to publicly admit it).
Looks like Amazon to me. Nobody else would dare this, but Amazon is known for such contracts. Well, they really must pay a LOT to get people sign over everything :)
If we're guessing, another reasonable guess is that they worked out a licensing deal so they wouldn't have to fight Amazon but they could still go after the next guy that tries it.
This would also set precedent, Amazon would have to change their practice or risk getting sued nonstop. Both would cost a lot more than just a billion dollars.
Sending a signal and waiting for a reply is communication. An agreement doesn't have to be written, or even spoken. Amazon colluded by effectively using the price as a carrier signal.
