This should have been tried before a different judge. The jury misconduct claims also reflect on judge Koh, she has a stake in letting her old verdict stand.

It's great news for justice. These guys should do time. I read back in March (I can't find the link but I think it was the Economist) that the case had been dismissed.

BUT the request to postpone the trial is DENIED. Case will proceed on original schedule. Chalk that up as win for Twitter, I reckon.

How did Koh not interpret the law impartially ?

The fact is that the Samsung lawyers failed to convince an independent jury of the general public. Koh had very little to do with it.


No they haven't; the case is still ongoing, remanded to the district court.

N.B. this has not yet gone to a full trial, this is a preliminary judgement.

"The Court gave final approval to the Settlement and overruled all objections on January 13, 2020. However, some of those that objected to the Settlement have now appealed the Court’s decision to approve the Settlement. By order of the Court, the Settlement cannot become final until all appeals are resolved and there is currently no timeline for the resolution of these appeals. When the appellate court enters a schedule for the appeal, we will update this website to provide individuals with more guidance as to the timing of a decision. Not very false. They're not continuing the trial past the end of this year. Which is exactly what it said in the article I read about it.

Frankly, this article seems more misleading than the ones it is complaining about.


The ruling published yesterday was just summary judgements which can be appealed. The actual trial hasn't even happened yet.

Appeals aren't retrials, though.

How does any of this change or contradict what I said?

And doesn't the US legal system allow for escalation to the Supreme Court, which can override lower courts? So technically whatever the Delware Court is not the final say on whatever happens.

According to the article the case was appealed and a verdict on the appeal has not yet been issued.

Did you read the part that said, "The case was remanded back to the D.C. District Court for further proceedings on this matter, with Judge Colleen Kollar-Kotelly presiding." That's not a win. The case was ongoing, and likely would have gone to the Supreme Court eventually, though the court was too cowardly to take the case immediately.

There was a settlement with the DoJ. You don't settle when you win and the other side loses.


Sadly yes. The court case in India keeps getting delayed and delayed. I think next hearing is Feb 8th?
