That doesn't matter when it's illegal. Statute overrides contract.

sort by: page size:

You can't be contractually compelled to do something illegal.

You realize that contracts don't override the law, right?

That's still not illegal: it's breach of contract.

Just because something isn't illegal/breach of contract doesn't mean it's right.

The fact something is in a contract doesn't make it legal or enforceable.

But contracts aren't supposed to have provisions in them that are against the law.

You can't make a contract that violates the law. Come on.

Just a nitpick - the contract is not illegal. It is not legally enforceable or valid.

Breaking a contract is not illegal. Seems to be a common misconception.

It's not, generally speaking, a criminal offense to violate a contract, I don't believe (IANAL!).

You realize that contracts can't contain illegal clauses right? They aren't enforceable in any court.

It can't be a crime. The contract is always executed exactly as written.

Contracts or terms don't have to be legal

Breach of contract is illegal, even though its not (in and of itself) criminal.

Not all contracts are legal.

Except for the fact that exercising a clause in a contract isn't a crime.

I don't see how it would be an illegal contract?

It can in some circumstances. If the action is illegal in the first place, no contract can make it OK.

Except that no contract can override the law, at last not where I live.
